Privacy Notice

LOGIKOSS, S.A.P.I. DE C.V., with registered office at Calle Oso number 127, office 206, Colonia del Valle Sur, Benito Juárez, 03104, Mexico City (hereinafter referred to as “LOGIKOSS”), makes this Privacy Notice available to you to comply with the provisions established in Article 14 of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter referred to as “the Law”), as well as its Regulations, and to inform you of the processing given to the personal data that you, as the Data Subject, provide to us. 

Personal Data Subject to Processing 

The personal data, sensitive personal data, and financial or asset data collected will be processed and safeguarded based on the principles established in the Law and its Regulations, which are: legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility. To fulfill the purposes set forth below, the data we require you to provide are as follows: name(s) and surname(s), nationality, a copy of your official identification, address, proof of address, phone number (landline and mobile), email address, RFC, a copy of your tax identification card, and proof of compliance with tax obligations. 

LOGIKOSS facilities are equipped with surveillance cameras, so if you visit them, you may be recorded by these cameras. The sounds and images captured will be used at all times to ensure your safety and the safety of individuals within LOGIKOSS facilities, its subsidiaries and/or affiliates, as well as employees, suppliers, customers, and visitors. 

Financial or Asset Data: -Bank institution where you have an account, bank branch, address of the bank branch, bank account number, CLABE, ABA, SWIFT, IBAN, routing; data used for invoice payment purposes and/or refunds of erroneously or excessively paid amounts and transfer amounts. 

Sensitive Personal Data.- Please be informed that to fulfill the purposes outlined in this Privacy Notice, the following sensitive personal data will be collected and processed: proof of compliance with tax obligations. 

Other personal data, both sensitive and non-sensitive, not listed above may be processed, provided that such data are of the same nature or do not exceed the purposes for which they are collected. 

 Purposes and/or Uses of Personal Data Your personal data will be processed to fulfill obligations arising from the relationship with you; to maintain a file; to establish payment schemes, evaluate credit applications, grant credits, and generate statistical reports; to comply with security measures and security audits at our offices; to contact you for internal communications; to prepare records related to the performance of our activities; to comply with service provision contracts we offer to our clients; to contact you if necessary; for administrative purposes, to comply with legal obligations, and to resolve or defend legal claims; for marketing and advertising purposes (sending newsletters, updates, and promotions). Your data may be processed for other purposes as long as such purposes are compatible with the ones described above and can be considered analogous. 

Transfer of Personal Data We inform you that to carry out business operations and to fulfill the described purposes, your personal data may be transferred through any communication within or outside Mexican territory, made to a person other than the holder, the person in charge, or LOGIKOSS, in accordance with the provisions of Article 35 of the Law. 

 Security Regarding Your Personal Data.- LOGIKOSS has implemented the necessary administrative, technical, and physical security measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing. Access to your personal data will be restricted to individuals who need to access such information to fulfill the purposes identified in this Privacy Notice. 

Use of Tracking Technologies on Our Website.- We inform you that our website uses cookies and other technologies that allow us to monitor your behavior as an Internet user, providing you with better service and user experience while browsing our site, as well as offering new products and services based on your preferences. 

The personal data we obtain from these tracking technologies include: browsing time, time spent on our website, sections visited, websites accessed prior to ours, username, password, and quotation data (origin, destination, cargo characteristics, flight date). 

Additionally, we inform you that the personal data obtained through these technologies will be shared with the following individuals, companies, organizations, or authorities other than us, for the following purposes:

Rights Regarding Your Personal Data.- You may exercise before the Personal Data Processing Manager of LOGIKOSS the rights of access, rectification, cancellation (including files, records, dossiers, and systems of LOGIKOSS where the holder's personal data are stored), and opposition to the processing of personal data ("ARCO" rights) established in the Law. You may also revoke, at any time, the consent you have granted, which may be necessary for the processing of your personal data, and request that the use or disclosure of your personal data be limited. 

To exercise ARCO Rights, you or your representative must submit a request to the email address privacidad@logikoss.com or directly at the address located at Calle Oso number 127, office 206, Colonia del Valle Sur, Benito Juárez, 03104, Mexico City, addressed to the Administrative and Legal Department with the following information and documentation: 

  • Name and address of the holder or any other means to receive the response to your request; 
  • Documents proving your identity (a simple copy in printed or electronic format of your voter ID card, passport, FM-3, national military service card, professional license, postal identity card issued by SEPOMEX, certificate or proof of studies, proof of residence, IMSS affiliation card, and/or ISSSTE affiliation card) or, if applicable, the legal representation of the Holder (a simple copy in printed or electronic format of the power of attorney with the autograph signature of the Holder, the representative, and their corresponding official identifications); 
  • A clear and precise description of the personal data for which you seek to exercise any of the ARCO Rights; and 
  • Any other element or document that facilitates the location of the holder's personal data. 

 

Changes to the Privacy Notice In the event of total or partial changes or modifications to this Privacy Notice, the updated version of the Privacy Notice will be made available to you via the email address you have provided or directly on our website: www.logikoss.com. 

I hereby state that I have read and understood this Privacy Notice and give my consent, where necessary, for the processing of my personal data under the terms of this document. 

The contents of this Privacy Notice will not, under any circumstances, be construed as a commercial or business relationship between LOGIKOSS and you. 

Pursuant to the Law and its Regulations, we inform you that if you receive a negative response to your ARCO rights request or if you disagree with it, you may file the corresponding Rights Protection Request with the Secretariat of Anti-Corruption and Good Governance, within the deadlines and terms established by the Law and its Regulations.
