Welcome to logikoss.com. This site is offered as a service to our customers and potential customers. Please review the following basic rules governing the use of our site, as well as some conditions regarding the services offered. Please note that the use of our site, as well as making quotations, reservations, or contracting shipments of one or more freights, implies unconditional acceptance, for yourself or any third party, to comply with and be bound by these Terms and Conditions.

"Logikoss, S.A.P.I. de C.V." (hereinafter referred to as "The Owner") owns the logikoss.com domain logikoss.com and reserves the right to update or modify these Terms and Conditions at any time without notice.

Definitions

Quotation means performing a service order exercise to obtain the cost of a shipment.

Reservation means placing one or more service orders within the logikoss.com portal. logikoss.com.

Shipment means the cargo transported under the terms of a single AWB (Airway Bill), regardless of the dimensions and/or number of pieces included.

No Show means the cancellation or failure to present the cargo by a customer and/or potential customer regarding a previously reserved and/or contracted service.

The consultation of any content on the portal does not constitute any contractual relationship between the user and The Owner, except for the relationship that may arise as a result of contracting a shipment.

Services Provided

logikoss.com provides quotations for air shipments from a wide variety of airlines. Through this website, an online tool is offered to reserve and contract the transportation of your shipments through a user-friendly portal.

The customer and/or potential customer acknowledges that a shipment cannot be accepted in the following cases:

When the goods are considered prohibited or restricted under international agreements, as well as in accordance with the criteria of the relevant authorities in each of the countries where the cargo is to be moved.
The required customs declaration is not made in accordance with the customs regulations of each country from and to which the cargo is to be transported.
Contains counterfeit products, animals, precious metals or stones, currency, weapons, explosives, ammunition, human remains, pornography, money, perishable goods, medications, illegal substances, or any other product considered risky or prohibited according to each local legislation.

The customer and/or potential customer will be solely responsible for entering the information required to generate quotes and book shipments, with the understanding that such information will be truthful and accurate. Neither The Owner nor logikoss.com will be responsible at any time for any incorrect, erroneous, or missing information.

It is important to note that neither The Owner nor logikoss.com acts on behalf of the customer and/or potential customer when booking a shipment. The customer and/or potential customer will always be responsible for the information provided in the reservation made.

The customer and/or potential customer acknowledges that the airline is the actual carrier of the cargo.

By selecting and accepting a rate to make the reservation, the customer and/or potential customer adheres to the terms and conditions of the AWB of the airline with which the merchandise will be transported.

In no case will The Owner or logikoss.com perform customs clearance on behalf of the customer and/or potential customer.

The customer and/or potential customer will be solely responsible for insuring the cargo to be transported.

Neither The Owner nor logikoss.com will be liable for any damage or loss of the merchandise that the customer and/or potential customer wishes to transport. In case of any damage or loss, The Owner and/or logikoss.com only obligation will be to forward the customer’s claim to the airline or carrier contracted for the transportation service. The sole responsibility of The Owner and/or logikoss.com will be to deliver the response issued by the airline or carrier to the customer.

The customer expressly acknowledges that The Owner and/or logikoss.com will not be liable in any case for any cancellation or delay by the airline or carrier with whom the customer has booked or contracted through The Owner and/or logikoss.com.

The rates provided through logikoss.com do not include the following:

Shipping to or from a residential area
Personal goods, cars, motorcycles, or transport vehicles
Waste material or scrap of any kind
Frozen, refrigerated, or temperature-controlled products
Antiques or works of art
Jewelry, precious stones, precious metals
Bullion, coins, or monetary-use products
Weapons, ammunition, or parts of weapons
Dangerous or flammable products
Furs and/or ivory
Human remains, ashes, human fluids, or tissue samples
Products considered illegal at any transit point
Insects, larvae, pupae, or any live animal
Tobacco, tobacco leaves, cigarette products
Liquors or beer
Drugs or narcotics
Unpackaged agricultural products, including grains, seeds, or food
Untreated wood or wood products

In the event of any additional cost to the rates provided through logikoss.com, such costs will be notified, as far as possible, by The Owner and/or logikoss.com, siendo responsabilidad única y exclusiva del cliente el proceder con el pago de los mismos, en el entendido que libera de toda responsabilidad a El Titular y/o logikoss.com from any responsibility for any payment that must be made for such concepts.

In this regard, the services covered by the generated quotation are subject to the terms and conditions printed on the air waybill, invoices, and/or generally accepted commercial practices in the industry and applicable contracts, as appropriate, which are available to interested parties upon written request.

The rates contained in the generated quotation are subject to the validity indicated therein, as well as to the specific characteristics of the contracted shipment, and may be subject to change without prior notice due to, without limitation, the following causes: (i) exchange rate fluctuations, (ii) international freight market rates, (iii) when there are variations between the declared weight of the goods and the actual weight, (iv) when there are variations in the declared dimensions of the goods and the actual dimensions, and/or (v) any other similar cause. You agree, acknowledge, and accept that the lack of confirmation of these rates and the corresponding instruction to carry out the shipment within the previously indicated validity will imply the need to review the aforementioned rates through a new quotation. Please note that payment for any type of freight must be made in US dollars, and the payment must be made at the time of receiving the corresponding CFDI, except in cases documented in writing between The Owner and the client where installment payment facilities have been granted. If payment is not made at that time, logikoss.com will have the right to retain the goods subject to the Service Order, establishing a pledge guarantee, until the corresponding payment is made, for which logikoss.com must receive the corresponding proof of payment and, in turn, confirm the receipt of funds in its bank accounts. The generated quotation exclusively refers to the services described therein and does not include services not specified but that may be required depending on the contracted service. The generated quotation does not cover taxes, tariff and non-tariff quotas, handling fees, delay charges, storage fees, loading or unloading movements, or any other similar charges.

Furthermore, please be advised that our liability will not exceed the limits established by applicable international agreements, including, without limitation, DM, CRM, IATA, HAGUE RULES, FIATA, WARSAWY, and the Federal Roads, Bridges, and Motor Transport Law. We inform you that our transportation operations are subject to FIATA regulations. Therefore, the goods travel at the customer's own risk unless insurance is contracted upon the client's prior request and mutual written agreement between both parties. Please note that our liability in transportation operations is limited and therefore cannot exceed that assumed by the airlines, ground transport companies, or any other intermediary or subcontractor involved in the course of the transportation or service provided. Freight charges are subject to fluctuations in air and ground transport rates.

The user, client, and/or potential client acknowledges that The Owner and/or logikoss.com are not in any case able to precisely know the content of the shipments nor to verify the truthfulness and accuracy of their documentation. Therefore, at all times, the user, client, and/or potential client will be solely responsible for the confiscation of goods or any other act of authority, the payment of fines and surcharges, non-compliance with regulations, as well as any legal sanction imposed by the relevant authorities, whether judicial, administrative, or otherwise, when such sanctions arise from the inaccuracy or falsity of the information and/or documents provided by the client and/or potential client to The Owner and/or logikoss.com

The user, client, and/or potential client shall indemnify The Owner and/or logikoss.com for any loss, damage, harm, expenses, and liabilities assumed before third parties, arising from compliance with the instructions of the user, client, and/or potential client, or due to any negligence or breach by them. Likewise, the user, client, and/or potential client will be required to pay carriers, The Owner, and/or logikoss.com all expenses, amounts, and/or penalties generated as a consequence of any cancellation of previously reserved and/or contracted services, as well as for any "No Show".

The Owner and/or logikoss.com will NOT be responsible for any itinerary changes and commits only to notify the user and/or client, as commercially possible, regarding modifications to itineraries. Therefore, neither The Owner nor logikoss.com will be held responsible if the client does not receive the corresponding notification.

The Owner and/or logikoss.com will NOT be responsible for any misuse of the account generated within logikoss.comby the user, client, and/or potential client. Therefore, the user, client, and/or potential client assumes full responsibility for its use and must immediately inform The Owner if their account is used by any unauthorized third party. In such cases, The Owner reserves the right to change the username and password of the client and/or potential client to protect the data they have provided.

Copyrights and Trademarks

Unless otherwise indicated, all materials, including images, texts, illustrations, designs, icons, photographs, programs, videos, and other written and non-written materials that form or are part of this Site (hereinafter referred to as the "Contents") are copyrights, trademarks, and/or intellectual property rights owned by The Owner or third parties and are protected by the Federal Copyright Law, Industrial Property Law, and other applicable laws in Mexico, as well as the International Treaties to which our country is a party. The compilation (that is, the collection, arrangement, and integration) of all the content on this site is the exclusive property of The Owner and is also protected by Mexican and International laws.

The Owner expressly reserves all intellectual property rights over all texts, programs, products, services, processes, technology, content, and other materials that appear on this website. Access to this website does not grant and should not be considered as granting a license to use The Owner's intellectual property rights.

The trademarks LOGIKOSS®, LOGIKOINS®, and LOGIKOSS.COM are duly registered and are owned by LOGIKOSS, S.A.P.I. DE C.V., or by the owners who have granted the license to "The Owner." It should be noted that the aforementioned trademarks may be used worldwide by "The Owner." No license to use the trademark or service mark concerning the materials contained on this website is granted. Access to this website does not authorize any person to use any name, logo, or trademark in any way.

References on this website to names, trademarks, products, or services of third parties or hyperlinks to third-party sites or information are provided solely for convenience and do not constitute or imply endorsement, sponsorship, or recommendation by The Owner concerning any third party, information, product, or service. Website Usage

The Owner commits to employing the resources available to prevent any error that may arise on the website. However, The Owner will be exempt from any responsibility for any error that may occur in the website's content.

The Owner will not be responsible for any discrepancy that may exist between the electronic and printed versions of the portal. In case of any discrepancy between the versions, the printed version will prevail.

Logikoss® User and Access Key

he use of user accounts and access keys to the Logikoss® platform is the exclusive responsibility of the user, client, and/or potential client. From the moment The Owner notifies the assignment of their account and the corresponding access key, the user, client, and/or potential client acknowledges and accepts as their own all operations carried out through the Logikoss® platform using said users and access keys. For all legal purposes, they expressly acknowledge and accept the personal and non-transferable nature of the user and access keys assigned for the use of the Logikoss® platform.

The user, client, and/or potential client accepts that once the user accounts and access keys are assigned, they will be solely responsible for their proper custody. Their use for contracting any type of service will replace the handwritten signature with an electronic one, so the documentary or technical records derived from the use of the platform, where the user and access keys appear, will produce the same effects as documents signed by the parties and will have the same evidentiary value.

If, due to negligence, fault, willful misconduct, or bad faith of the client and/or potential client or the users authorized by them to use the same, security measures for system access are breached, The Owner will be released from any responsibility for executing the instructions received through the platform, without prejudice to any civil and/or criminal actions that may be taken against the responsible party. The Owner will also be released from any responsibility for executing instructions received through the platform, even if the access keys have been lost by the client and/or potential client, provided that they did not notify The Owner in writing with due anticipation to take necessary measures to prevent unauthorized third-party access.

User Comments, Feedback, Communications, and Other Materials

The Owner will be the sole owner of any comments or feedback made by users of the site and will not be limited in any way in its use, whether for commercial or any other purpose. The Owner has no obligation to: (1) keep the Comments confidential; (2) pay the user any compensation for them; or (3) respond to any user's Comments. You agree that none of the Comments you make on the Site will violate the rights of third parties, including copyright, industrial property rights, personal data processing, or other personal or property rights. Additionally, you agree that no Comment you make on the Site will contain defamatory, illegal, offensive, or obscene material.
